The Amendments discourage use of tried-and-true drugs

"For the same monetary reasons described above, pharmaceutical firms usually prefer to develop new NCEs rather than gain a 'secondary indication' for a compound already on the market. Manufacturers must gain a new, although less expensive, FDA approval if they wish to promote a drug for a use not covered in their original application. However, the testing takes time and the drug is likely to lose its patent exclusivity in the meantime." (05/08/11)
