"Federal Judge Henry Hudson has dealt Obamacare its first Constitutional setback. Its individual mandate exceeded Congress’ authority under the Commerce Clause, never before extended to 'regulation of a person’s decision not to purchase a product,' which 'would invite unbridled exercise of federal police powers.' With the Commerce Clause the sole justification for many federal regulatory powers nowhere Constitutionally enumerated (it is called 'the everything clause' in law schools), the ruling was instantly attacked by liberals."
